Software Agreement and Distribution

Software Agreement
This agreement applies to the use of the APERO program (in binary code form) as
well as its corresponding documentation. It will be delivered free of charge.
We grant a personal, nontransferable and nonexclusive right to use APERO for
internal research and internal educational purposes only.
APERO has been developed using New Jersey Standard ML from AT&T Bell
Laboratories. APERO embodies several NJ/SML exported executable files.
We warrant that APERO does not infringe upon patents, copyrights, trade secret
rights or any other rights or third parties. In the event that a third party
asserts any such rights, the licensee shall not be held responsible for the use
of APERO under this agreement.
The licensee agrees that it will not use APERO in a way which would not be in
accordance with the present agreement.
The licensee agrees that it will not sell, lease, distribute or otherwise
transfer or dispose of APERO, in whole or in part, to any other party.
Neither the execution of this agreement nor anything in it shall be construed
as an obligation upon us to provide any correction or amelioration possibly
requested by the licensee and even to deliver to the licensee the most recent
versions of APERO.
Neither the execution of this agreement nor anything in it shall be construed
as an obligation upon us to furnish any person, including the licensee, any
assistance of any kind, or any information other than the APERO tool to be
delivered.
We disclaim all warranties, either expressed or implied, with regard to APERO,
including all implied warranties of merchantability and fitness.
In no event shall we be liable for any special, indirect or consequential
damages, any damages whatsoever resulting from loss of use, data or profits,
whether in an action of contract, negligence or other tortuous action, arising
out of or in connection with the use or performance of APERO; we shall not
assume the cost of all necessary servicing, repair or correction.
The licensee agrees that it will clearly mention and acknowledge the names of
APERO and the University of Liège in any public performance or
demonstration of APERO and in all articles and publications involving use of
APERO.
This agreement shall become effective immediately.
